New York Chapter 7 Bankruptcy Attorney

Is Chapter 7 Bankruptcy Right for You?

There are a variety of options that can allow you to overcome debt. Some of them you may qualify for, others you may not. Some of them may be good options for you, others may not.

At the Law Office of Patrick M. Noe, Jr., we believe that your path to overcoming debt needs to be chosen carefully. We will take the time to learn about your situation. When our attorney offers you guidance, you can be confident that it's based on our commitment to doing what is best for you.

In many cases, we determine that filing Chapter 7 bankruptcy is the most effective option to overcome debt.

What is Chapter 7 Bankruptcy?

This form of bankruptcy is also referred to as liquidation. It allows people to discharge all or most of their unsecured debt, thus allowing them to get their financial situation under control.

The types of debt that can be discharged through Chapter 7 include credit card debt and medical bills, as well as some types of back taxes.

Depending on your situation, you may still be able to keep your house, your car and other major assets, while still overcoming your debt.

The Chapter 7 Bankruptcy Process

After we determine that Chapter 7 is right for you, the process itself starts with paperwork. Forms will need to be filled out that list your income and expenses, as well as your assets and debts. This paperwork will then be filed with the court.

The next major step involves meeting with your lawyer and a bankruptcy trustee at a meeting of creditors to answer some questions about your case. Again, this step is fairly straight-forward.

Finally, if the request is granted, you will receive a discharge of debt in about three months. You will essentially be debt free.
